UK Government Rules Israel Is Not Committing Genocide in Gaza.

The British government has formally concluded that Israel’s military actions in Gaza do not meet the legal definition of genocide, marking a significant shift from its earlier stance that only courts could decide such matters.

Deputy Prime Minister David Lammy, writing in a letter dated September 1 to Sarah Champion, chair of the international development committee, said ministers had “carefully considered” Israel’s conduct under the 1948 Genocide Convention and found no evidence of intent to destroy a national, ethnic, racial, or religious group.

“The situation in Gaza is utterly appalling and Israel must do much more to prevent and alleviate the suffering that this conflict is causing,” Lammy wrote. “But the Government has not concluded that Israel is acting with genocidal intent.”

The International Court of Justice has warned of risks of genocide but has not found Israel in breach of its obligations, nor has it declared that genocide is taking place. Britain’s position now explicitly aligns with that view — a first for the government.

The disclosure came quietly. The letter was released at midnight during a cabinet reshuffle, a timing critics said was designed to avoid public scrutiny. Sir Michael Ellis KC, a former Attorney General, called it “buried news” but welcomed the clarity: “It is now confirmed that the UK Government has concluded that Israel is not committing genocide. There has never been any evidence of such a thing.”

Still, rights groups argue the letter sidesteps wider accountability questions, including the UK’s duty to prevent atrocities and its handling of arms exports.

On that front, Lammy defended the continuation of British participation in the global F-35 fighter jet program, stressing its importance for NATO deterrence and European security. While the UK has suspended direct exports of F-35 parts for use by Israel, he said halting contributions to the wider international program “would significantly disrupt international peace and security.”

The decision is already stirring political debate. Pro-Palestinian activists accuse the government of closing ranks with Israel, while pro-Israel voices argue it finally undercuts months of damaging rhetoric about genocide.

For now, Britain has placed itself firmly on record: Israel is not committing genocide in Gaza.
